Everyone here is trying to be so polite. This story stinks to me.
So basically you HAD to take back the car... due to all the errors,... like failing to report the sale, lost sales receipt and forgetting to take your plates... all caused by you. Paying the $75 ticket seems to me a proper penalty for those mistakes. You probably could have gotten out of that too if you went to court. Why not just pay it at the time and chalk it up to silly errors you will never do again and move on. Ahh the temptation of reuniting with a former lover ie: Caprice. Someone will take advantage of the buyers ignorance and impound situation... why not you right?
So, you confirmed by not denying you are the owner then proceeded to get "your" car out of impound. Once this position was taken by you, you further entrenched yourself into ownership role and proved ownership at a government office, DMV.
Are you justifying taking the car back by mentioning the exposure you had since the "nimrod" buyer failed to register in his name? You could have told the DMV about the sale. You can't say all DMV's are different or play confused citizen. This is common sense. Make a sale, report it.
It seems simple. Once you sell something, it is sold. I would put my money on any judge in any state determining that very same thing. You inserted yourself fraudulently as car owner at the impound lot and DMV. You may find some creative way to keep the car now ie: convenient title still in your name, renewing title at DMV to get car or just being more sophisticated than buyer... If that babe in the woods comes back you can now hang that $20/day storage, mention the ticket and how you were exposed legally since he never registered it. He'll probably back down. It doesn't seem right though.
I have a question for you: "When the impound yard first contacted you, what efforts were made to track down the buyer?" You said on an earlier thread that buyer provided 5 personal references because you financed for him. "Did you call any of them when you found out what was up with the car? Did you ask your Sheriff buddy how to track him down? Or did you only ask the Sheriff buddy how you can keep possession of the car?"
You kept tight tabs on him while he was making payments to you and you salivated over his upgrades and repairs and confirmed he insured it... seems perhaps you outsmarted him in the end!
