im not denying some of this is because i failed to follow procedure over a year ago when i sold it. my mistake that came back and bite me. but, in nm its not a requirement to file the papers, i was just supposed to keep the plates. filing the papers would have gotten me out of the ticket i had to pay, but its too late for that now. when contacted i did go back and dig thru every paper i had, and could not find any contact info for the guy. as mentioned before, when the deal was done, i tossed it all. i called his work, or at least where he did work, and they told me he was fired 8 months ago and couldnt/wouldnt give me any contact info. this was all done before i went to the dmv to get the new title. i was contacted thursday before last and didnt go to get it untill last monday. the time between there i was trying to track him down an seeing what options i had. i did tell the dmv what was going on, at which point i was told i am responcible for the car if its titled in my name unless i could provide solid PROOF of the sale. they were not just gonna take my word it was sold.i went over all this in a previous post BTW.
yes i have done everything i can come up with to contact the guy. its not like i sold it to a buddy, we were strangers before the sale. so i really have no idea how to track him down. he knows far more about how to find me then i know about him. all the dealings were done at my office. he made about 8 trips here between payments, test drives, etc etc. so he knows how to get in touch with me pretty easy. everyone in my office has also been instructed to give the guy my cell number should he show up while im out.
i feel justified in what im doing in order to recoop my expenses. i was extremely cool with this guy during the purchase, i went out of my way, and put myself at some legal risk to help the dude out by not insisting the title get transferred right away as i usually do. i even let him take possesion of the car when he hit the halfway point of payments so he could get to work after breking up with his girlfriend that was his ride at that point, which i didnt have to do. i went out of my way for this dude to get bent over better then a year later. so i dont care about being completely 100% in the right at this point. how right i am depends on which side of the coin your looking at it from. if he comes back, he should be thankfull i did rescue it and pay me what im out with a smile on his face. simply because had i not gotten it, as of friday it would the the propery of el paso and he wouldnt have any chance at all of getting his ride back. this way he does have a chance to get his car back. as mentoned before, i prolonged how long the car will be in limbo, this is in his favor, not mine. as far as the $20 a day storage fee, im simply useing this to set a time limit on when he is out of time to act. if i dont use a storage fee, then the car will have to sit here indefinatly and thats not gonna happen. if he shows, and wants the car back, i doubt ill even mention any storage fee. pay me the fines and what i have been out, and get the hell out of my face. i have already removed the plates, gotten the "sold" paper work and filled it out with everything but a date and his signature, and filled out the form to transfer the plates to my nova should he return. you know, all the stuff i should have done before. if he doesnt show, then i have some good parts.
"Someone will take advantage of the buyers ignorance and impound situation... why not you right?"... how exactly am i taking advantage of him??? he will have to pay exactly what i did, and/or what he would have had he showed up on that day at that time to claim it. i have added approximatly 60 days to the time in which he has to save the car. as of 6pm friday the car WOULD have been lost for good, now hes got some extra time to act at no extra cost. to be 100% honest, at the time i wasnt thinking about what i could get out of it, that has all been after thoughts. all i was concerned with was not getting stuck with increasing fines, having the impound yard possibly sue me over said fines, and i was extremely pissed off that he hadnt transferred title and i had to deal with all this crap.
